Welcome to Ezi-Connect SMS Gateway. These Terms and Conditions ("Terms") govern your use of our SMS gateway services ("Service"). By accessing or using Ezi-Connect, you agree to be bound by these Terms.

1. Definitions

"Service" refers to the SMS gateway services provided by Ezi-Connect.
"User" or "You" means any individual or organization using the Service.
"SMS Credits" means prepaid units purchased to send SMS messages through the Service.

2. Account Registration and API Keys

2.1 You must register an account to use the Service. You agree to provide accurate and complete information.

2.2 You are responsible for maintaining the confidentiality of your API keys and account credentials.

2.3 Any activity under your account/API key is your responsibility.

3. Use of Service

3.1 You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.

3.2 You will not use the Service to send spam, unsolicited marketing messages, or any content that is illegal, offensive, defamatory, or infringes third-party rights.

3.3 Ezi-Connect reserves the right to suspend or terminate accounts that violate these Terms.

4. SMS Credits and Packages

4.1 SMS Credits are prepaid and non-transferable.

4.2 Credits are valid for 12 months from the date of purchase unless otherwise stated.

4.3 SMS messages are deducted from your balance based on the number of message segments sent.

5. Payment and Fees

5.1 All fees are due in advance and are non-refundable except as outlined in Section 8.

5.2 Prices and packages are subject to change with prior notice.

5.3 You are responsible for any taxes associated with your use of the Service.

6. Service Availability and Disclaimer

6.1 While Ezi-Connect aims to provide reliable service, we do not guarantee uninterrupted or error-free operation.

6.2 Delivery of SMS messages depends on third-party mobile network operators and is outside our control.

6.3 Ezi-Connect is not liable for delays, failures, or errors in SMS delivery.

7. Data Privacy

7.1 We collect and process your data in accordance with our Privacy Policy.

7.2 You agree to obtain any necessary consents from message recipients as required by applicable law.

8. Refund and Cancellation Policy

8.1 General Terms

• By using Ezi-Connect, you accept this Refund and Cancellation Policy in addition to these Terms.
• All fees are payable in Zambian Kwacha (ZMW).
• SMS Credits are non-transferable and can only be used within the Ezi-Connect platform.

8.2 Refund Eligibility

Refunds may be granted only in these cases:

• Service outage exceeding 24 continuous hours not caused by your systems.
• Duplicate payments due to technical errors.
• SMS Credits not delivered within 48 hours and unresolved by support.

Refunds will NOT be granted for:

• Messages successfully delivered to the mobile network, including recipient device issues.
• Unused credits after 30 days.
• Account suspension for Terms violation.
• Delivery failures caused by mobile networks.

8.3 Cancellation

• You may cancel your account anytime by contacting support@ezi-connect.upliftservices.us.

• Cancellation immediately suspends SMS sending and forfeits unused credits unless refund eligible.

• Subscription fees are non-refundable except as required by law.

8.4 Refund Process

• Submit refund requests within 7 days of transaction to info@ezi-connect.upliftservices.us with proof and explanation.

• Approved refunds processed within 7 business days for card/PayPal and 14 days for bank transfers.

9. Limitation of Liability

To the fullest extent permitted by law, Ezi-Connect shall not be liable for indirect, incidental, or consequential damages arising from the use of or inability to use the Service.

10. Indemnification

You agree to indemnify and hold harmless Ezi-Connect, its affiliates, and employees from any claims, damages, liabilities arising from your use of the Service or violation of these Terms.

11. Intellectual Property

All content, trademarks, logos, and software related to Ezi-Connect are the property of Ezi-Connect or its licensors. You may not use them without permission.

12. Governing Law

These Terms are governed by the laws of Zambia. Any disputes shall be resolved in the courts of Zambia.

13. Changes to Terms

Ezi-Connect may update these Terms at any time. Updates will be posted on our website, and continued use of the Service constitutes acceptance of the changes.
